Court Defers Plea
A Nairobi court has postponed the plea-taking of former Cabinet Secretary Raphael Tuju as questions arise over his health and the court’s authority to handle the case.
Tuju did not appear in court on Tuesday, with the prosecution informing the court that he had been taken to Karen Hospital for medical attention while in police custody.
Charges Against Tuju
According to court documents, Tuju is facing allegations of providing false information to a public officer, an offence under the Penal Code.
The charge stems from an incident on March 21, 2026, at Entim Sidai Spa & Wellness Sanctuary, where he allegedly reported being trailed and abducted by unknown individuals, claims investigators say were untrue.
Defence Pushes for Delay
Tuju’s legal team, led by Edward Oonge, requested more time, asking the court to defer the case for two weeks to allow him to recover.
The defence also sought a bond without cash terms, assuring the court that Tuju would present himself once his health improves. Lawyer Dan Maanzo challenged the validity of the charge, arguing it lacked a solid legal foundation and should be dismissed.
They further told the court that Tuju suffers from a recurring spinal condition that requires medical attention.
Prosecution Stands Firm
State prosecutor J. V. Owiti maintained that the court has jurisdiction and argued that proceedings can continue even in the absence of the accused.
He opposed granting bail or bond before the court could assess Tuju’s condition in person, emphasizing the need for proper medical evaluation first.
Owiti also stated that there was no indication of mistreatment while in custody and confirmed that Tuju would remain under police watch unless granted bail.
Court Awaits Medical Report
Chief Magistrate Stella Atambo directed that Tuju receive full medical care and announced that a ruling would be delivered after reviewing a doctor’s report on his condition.
The court is expected to determine both the jurisdiction issue and the next steps in the case.
