The High Court in Kisumu has sentenced Kevin Omondi Nyapietho to 35 years in prison after finding him guilty of killing his aunt, Gaudencia Otieno Aoko.
Justice Joe M. Omido delivered the judgment, ruling that the prosecution had presented enough evidence to prove the murder case beyond reasonable doubt.
The incident occurred on February 21, 2023, at Kapuonja Sub-location in Kisumu West Sub-County.
Aunt Had Taken Him In
Court proceedings revealed that Aoko had opened her home to Nyapietho after he lost both his parents.
She reportedly took on the responsibility of caring for him, effectively becoming a parental figure in his life.
However, their relationship took a tragic turn on the night Aoko was killed.
Dispute Escalates During Supper
According to evidence presented in court, Nyapietho became confrontational while the family was having supper.
He accused his aunt and her two children of plotting to poison him, allegations that were not supported by evidence.
After the confrontation, Nyapietho reportedly left the house and locked the occupants inside from outside.
One of his cousins, a secondary school student, subsequently secured the door from the inside, apparently for protection.
Nyapietho later returned and forced his way into the house.
Fatal Jembe Attack
Once inside, Nyapietho attacked his aunt using a jembe.
He struck Aoko on the head and shoulder with the sharp edge of the farming tool, leaving her with serious injuries.
A pathologist who conducted the postmortem examination told the court that Aoko died from severe head trauma caused by multiple lacerations.
Prosecution Proves Murder Case
The case was prosecuted by Mercy Mutheu Muema, who represented the Director of Public Prosecutions.
Nyapietho faced a murder charge under Sections 203 and 204 of the Penal Code.
In his judgment, Justice Omido found that the prosecution had established the key elements of the offence and demonstrated that Nyapietho was responsible for the unlawful attack that caused Aoko’s death.
The court consequently convicted him and imposed a 35-year custodial sentence.
