The Director of Public Prosecutions (DPP) has asked the High Court to deny bail to seven people accused of murdering psychiatrist Dr Victoria Mutiso, arguing that their release could put witnesses at risk and interfere with the ongoing case.

DPP Challenges Bail Application
The prosecution has moved against the release of seven people charged with the murder of psychiatrist Dr Victoria Mutiso.
The State made its submissions before Justice Alexander Muteti, asking the court to keep the accused in custody as the case proceeds.
The prosecution team, led by Deputy Director of Public Prosecutions Jalson Makori and supported by other members of the ODPP, told the court that releasing the accused could create risks for witnesses and their families.

Concerns Over Witnesses and Investigations
According to the prosecution, there are fears that the accused could interfere with witnesses or compromise other aspects of the case if released.
The State also argued that ongoing investigations and the eventual trial could be affected, particularly given what prosecutors described as the accused persons’ alleged connections, resources and ability to coordinate activities.
The prosecution claimed that the group had allegedly been involved in activities ranging from surveillance and gathering information to obtaining items allegedly used in the crime, as well as logistical and financial arrangements.
These allegations have not been proved in court.
Seven People Face Murder Charges
The accused persons are Rose Mbithe Mulwa, her children Chris Mulwa and Angela Mulwa, police officers Elijah Kibelion Kimono and Collins Bett, Martim Kimutai and Pius Muiru Mbugua.
They have all denied the murder allegations.
The prosecution alleges that the seven, together with other individuals who have not been brought before the court, were involved in the killing of Dr Mutiso.
Dr Mutiso Was Killed in Kilimani
According to the charge facing the accused, Dr Mutiso was allegedly murdered at around 9:30am on July 29, 2026.
The incident is said to have occurred along Mawensi Road in Kilimani Sub-County.
The circumstances surrounding her death have since triggered a wider investigation, with detectives and prosecutors examining the alleged roles of those accused and whether other people may have been involved.
The court will now consider the prosecution’s arguments against bail alongside the rights of the accused persons.
As the legal process continues, all seven remain presumed innocent unless and until a court determines otherwise.
