The Environmental and Land Court has ordered the closure of three clubs and a church in Mirema Estate and fined them 5 million Ksh for noise pollution.
This was directed by JHudy Omange, who ruled in favor of the Amani Residents Welfare Association/Mirema after an affidavit filed by the association’s chairman, Dominic Mbigi, and John Koogi, a resident of the estate, highlighted the challenges they face.
The clubs that will be closed are: Cocorico Wines, Paris Lounge and Grill, Tessara Entertainment, and the church, which is Trinity House International Ministry, as they have violated the residents’ right to a clean and healthy environment as enshrined in Article 42 of the Constitution.
The church was accused of using loud sound systems for preaching and services that were causing noise pollution, especially on Friday nights and Sundays.
They added that the noise levels disrupted learning activities in nearby schools and that the behaviours exhibited by those visiting the clubs are not exemplary to the children who stay close to the bars, and parents feel like that might affect their children’s growth.
