According to the prosecution, John Gitau Ngumi, Atek Otech Richard, and Bernard Otieno Mallo created a fake title deed under the name of Beba Freight Ltd. The forged document falsely suggested the land had been officially allocated by the Ministry of Lands and was used in an attempt to claim ownership and control of the valuable plot.

The court heard that the forged deed was submitted to relevant authorities and shared with third parties in a bid to mislead and fraudulently transact on the land.

The three suspects were arraigned at Milimani Law Courts, where they faced six serious charges including conspiracy to defraud, uttering a false document, and making a document without authority. They pleaded not guilty and were each released on a KSh 250,000 cash bail.

The court has since ruled in favour of Landmark Freight, confirming the company’s legitimate ownership of the contested property and effectively nullifying any claims made by the rival group.
