Acting IG Gilbert Masengeli Clarifies Recall of Justice Mugambi’s Security Detail

Acting Inspector General of Police Gilbert Masengeli has responded to criticism following the recall of Justice Lawrence Mugambi’s security detail. Masengeli explained that the officers were called back to attend VIP security training and assured that new officers had been assigned to protect the judge in their absence.

In a statement on Monday, Masengeli stated, “The two officers, being general duty officers, were recalled for purposes of attending VIP security courses. We are aware that suitable arrangements were made to ensure Hon. Mugambi’s security was always assured.”

This clarification follows widespread concern that the recall might have been linked to Justice Mugambi’s recent ruling against the police. However, Masengeli denied any connection, emphasizing that the judiciary continues to receive proper protection from law enforcement. “It is in the public domain that the IG has accorded the Judiciary, just like other arms of government, the requisite protection, both the institutions and the persons serving therein, without favour or discrimination,” Masengeli said.

Masengeli also addressed his absence from a recent court hearing on the issue. He explained that he was unable to attend due to ongoing operational meetings and had instead delegated the responsibility to the Deputy IG. “It is not clear why the Court insisted on the IG attending to this matter in person, yet an equally senior officer had been availed by the Service,” he added.

Chief Justice Martha Koome, in response to the situation, criticized the recall, stating that it contravened Article 160 of the Constitution, which ensures the independence of the judiciary. She pointed out that the security detail was withdrawn over the weekend after the officers’ firearms were confiscated, further intensifying concerns about the judge’s safety.

The recall has sparked debate over the proper treatment and protection of judicial officers in the country.
